鋸樹砸破工人頭 國父紀念館免賠

國父紀念館於委請軒信公司，負責館方管理的陽明山中山樓樹木修剪維護工作，2011年軒信員工楊男及王男工作時發生意外，楊男指控，館方不當指揮他們去鋸樹，導致王男鋸樹時，樹枝掉下將他的頭骨砸破，請求國家賠償169萬元，法院認為館方無疏失，判免賠。 法官認為，楊男及王男修剪的樹木，屬於合約範圍，館方沒有疏失，王男負責鋸伐及修剪樹木，楊男負責清理樹枝及交通維護，2人相互配合，但看不出王男鋸樹時有何疏失，判楊男敗訴，判決另指出，楊男案發後，在職災部分，已與軒信公司以50萬元和解。（劉志原╱台北報導）
